On January 28, 2016, after nearly 4 weeks of trial, a Lorain County, Ohio jury returned a verdict in favor of our client Tesar Industrial Contractors and against Republic Steel. The jury awarded Tesar damages totaling $3.5 million and rejected the counterclaims of Republic Steel in their entirety. In addition, the jury’s outright denial of Republic’s counterclaims relieved Tesar of $700,000 in subcontractor liability, which Republic paid out directly and then sought to recover against Tesar at trial.
The trial involved a series of complex disputes, requiring extensive expert testimony, arising out of the construction of a state of the art electric arc furnace and dust collection system at Republic Steel’s Lorain facility. The total cost of the project was $130 million.
