Evenchik, Pugh, Siedlarczyk Secure $7.9M Judgment in New York Fraud Dispute

Hahn Loeser Partners Aaron S. Evenchik and Charles W. Pugh, and Associate Colten J. Siedlarczyk secured a $7.9 million judgment, personally, against the president of a construction company based on a fraud claim, following evidentiary hearing in US District Court for the Eastern District of NY.  In this case, the defendant’s company was a subcontractor on a New York project being built by Evenchik and Pugh’s client – the general contractor for the project. The subcontractor failed to complete the job and abandoned the project. 

Evenchik and Pugh were able to prove that the defendant lied and created a fraudulent bond letter to get the project work. Evenchik and Pugh obtained a $10 million arbitration award against the defendant’s company for breach of contract and abandonment. However, because of the fraudulent bond letter, Evenchik and Pugh filed suit against the president of the defendant company, personally for fraud. The NY District Court awarded approximately $7.9 million to Evenchik and Pugh’s client for the fraud committed by the president of the defendant construction company. The client is very happy that justice was served.
